Oral Arguments Heard in Former DuBois Police Chief Lawsuit

CLEARFIELD –Oral arguments on preliminary objections to the lawsuit between former DuBois Police Chief Blane Clark and the City of DuBois began Tuesday.

We previously reported that the former Police Chief filed a lawsuit against the city, Mayor Patrick Reasinger, Councilwoman Jennifer Jackson, and Councilman Elliot Gelfand, claiming that his due process was violated, whistleblower laws violated, and his contract breached when he was placed on administrative leave last year.

The Defense stated that they want to dismiss the case saying it boils down to a former employee disgruntled about a lawful termination.

The judge agreed that Clark was not subject to the same rules as a normal employee, however he questioned who had the authority to terminate the former Police Chief.

The plaintiff argued that the Police Chief could not be terminated outright but demoted. The judge responded that he believed that may not be true.

After two hours of deliberation, the judge stated that he will take all arguments into consideration and make a decision on the dismissal at a later date.
